Guardianship certificates. In order to smooth the path for the the court to be involved and appoint a person to serve as the disabled’s guardian, the disabled needs to be examined two times.

Who can complete the Guardianship Certificates?

A petition for guardianship requires that the disabled be examined by two physicians or one physician with the second examination done by a licensed psychologist, licensed certified social worker, or nurse practitioner. A good resource for this examination can be the disabled’s primary care physician. Our office can assist you if you do not have a professional in mind to do both examinations.

Is there a specific form needed for these examinations?

Yes. Maryland Circuit Courts require that you must submit the examination results on court authorized forms. These forms are long and complex but are a necessary part of the guardianship process. We can assist you with obtaining the guardianship certificates.

What happens if my parent refuses to be examined for guardianship purposes?

It is not uncommon for a parent that is disabled who refuses to be examined for guardianship purposes. This is a scary process for many. The implication is that they are going to lose their freedom to self determine at a time they believe they do not need any help. It is certainly encouraged that a parent is convinced that an examination is necessary. However, if a parent refuses to be examined, then the guardianship process will require an initial hearing to determine if the Court should step in and require the two examinations. If both examinations come back and indicate that they meet the guardianship threshold, then the case continues. If either examination comes back negative, the case stops.
